Introduction

BloomFam ("Company" or "We") respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes:

  • The types of information we may collect or that you may provide when you create an account, access, or use the BloomFam (the "Service").
  • Our practices for collecting, using, maintaining, protecting, and disclosing that Information.

This policy applies only to information we collect in this Service, and in email, text, and other electronic communications sent through or in connection with this Service.

This policy DOES NOT apply to information that:

  • We collect offline or on any other Company apps or websites, including websites you may access through this Service.
  • You provide to or is collected by any third party, including other apps, websites, or content that may link to or be accessible from or through this Service.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, create an account, or use this Service. By downloading, creating an account, or using this Service, you agree to this privacy policy.

Information We Collect and How We Collect It

We collect information from and about users of our Service:

  • Directly from you when you provide it to us.
  • Automatically when you use the Service.

Information You Provide to Us

  • Personal Information: By which you may be personally identified, such as name, postal address, email address, telephone number, or any other identifier by which you may be contacted online or offline ("Personal Information").
  • Profile Information: Information about you that does not individually identify you, such as your experience with childcare, availability, and Service preferences.

User Vetting and Responsibility. BloomFam is a platform that connects Account Holders and Caretakers.

  • We do not interview or screen any users of the Service.
  • We do not interview, vet, screen, supervise, or control users, and we do not make recommendations, endorsements, or suitability determinations about any Account Holder or Caretaker.
  • You are solely responsible for interviewing, vetting, and selecting any Caretaker or Account Holder with whom you choose to interact or engage, and for complying with any legal obligations that apply to your use of background checks or other screening tools.
  • As noted in our Terms of Use, you are solely responsible for interviewing, vetting, and selecting a suitable Caretaker or Account Holder for your needs.
  • Background Check Services: Caretakers who consent to background checks, may upload a background check via Chekr; https://checkr.com/. A link to Chekr's Privacy Policy is provided below in the section labeled "Third Party Information Collection".

This information includes:

  • Information that you provide by filling in forms in the Service, including information provided when creating an account, requesting childcare services, or reporting a problem with the Service.
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
  • Details of transactions you carry out through the Service. You may be required to provide financial information before completing payments through the Service.
  • Messages and Communications: Content of messages sent through the messaging system between individuals seeking childcare (referred to as "Account Holders") and individuals who provide care to children (referred to as "Caretakers").
  • Basic Child Information: As described above, basic non-medical information about children to facilitate childcare services.

You may also provide information for publication or display on your profile areas of the Service ("User Contributions").

Your User Contributions are posted and transmitted to others at your own risk.

We cannot control the actions of third parties with whom you may choose to share your User Contributions.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Service, we may use automatic data collection technologies to collect certain information about your device and usage patterns, including:

  • Usage Details: When you access and use the Service, we automatically collect details of your access to and use of the Service, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Service.
  • Device Information: We collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
  • Location Information: This Service collects real-time information about the location of your device to facilitate and in accordance with various state privacy laws, we will ask for you specific consent before collecting this information. We collect this to facilitate:
    • Matching Account Holders with nearby available Caretakers
    • Providing location-based search and filtering
    • Enabling safety features during active childcare sessions
    • Verifying service completion and attendance
  • Stored Information and Files: The Service may access metadata and other information associated with files stored on your device, such as photographs for profile pictures and contact information that you have provided to us.

If you do not want us to collect location information, you may opt out through your device settings. However, please note that opting out of location collection will disable location-based matching features.

Third-Party Information Collection

When you use the Service, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties include:

  • Your mobile device manufacturer
  • Your mobile service provider
  • Background Check Services: BloomFam uses Chekr to provide background check services for Caretakers who chose to undergo verification.

  • Stripe (Payment Processing): We use Stripe to process payments. Stripe may collect payment information and transaction data in accordance with their privacy policy.

  • Analytic Providers: We may in the future use third-party analytics providers, such as Google Analytics, to help us understand Service usage and performance. These providers may collect information about your device and usage of our Service.
  • Advertising Services: BloomFam uses Google Adsense to display advertisements on our website or Services.
    • BloomFam does not share personal profile information, messages, or transactions details with Google Adsense.
    • Google may use this information to personalize advertisements you see on our platform or other websites across the internet.

These third parties may use tracking technologies to collect information about you when you use this Service. We do not control these third parties' tracking technologies or how they may be used.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the Service and its contents, and childcare services that you request from us.
  • Match Account Holders with suitable Caretakers based on location and preferences.
  • Facilitate communication between Account and Caretakers through our messaging system.
  • Notices about your account, including expiration and renewal notices.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • Notifications about Service updates and of any changes to any products or services we offer.
  • Security purposes, including to prevent and detect fraud, and to enforce our Terms of Use.

The usage information we collect helps us to improve our Service and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Service according to your individual interests.
  • Speed up your searches.
  • Recognize you when you use the Service.

We use location information we collect to match Account Holders with nearby Caretakers and to provide safety features during childcare sessions.

Sale or Sharing of Personal Information

BloomFam does not sell personal information for monetary compensation.

However, we may allow certain third-party advertising partners (such as Google AdSense) to collect device identifiers, cookies, and other online activity information through our Service to provide personalized advertising.

Under certain state privacy laws, this type of disclosure may be considered "sharing" personal information for cross-context behavioral advertising purposes.

Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements.

In general:

  • Account information: retained while your account is active and for a reasonable period thereafter for legal and operational purposes
  • Messaging data: retained for recordkeeping and dispute resolution purposes
  • Location data: retained only for the duration necessary to facilitate active childcare sessions and for limited security purposes
  • Payment information: retained in accordance with Stripe's retention policies
  • Child-related information: retained only as long as necessary to facilitate services and subject to periodic deletion protocols

Safety and Security Features

Child Safety Measures

BloomFam provides a mechanism for Users to report concerns or alleged misconduct occurring in connection with use of the Platform. Reports submitted through the Platform are reviewed by BloomFam personnel for potential violations of our Terms of Use.

BloomFam does not supervise childcare services and is not responsible for investigating or resolving disputes between Users. Where appropriate, we may take action within the Platform, including account suspension or removal, consistent with our Terms.

BloomFam does not routinely review, screen, or monitor user communications. However, we reserve the right to review communications where reasonably necessary to investigate suspected violations of our Terms of Use or applicable law.

  • Real-time location sharing during active childcare sessions
  • Secure messaging system with content monitoring capabilities
  • Incident reporting and response procedures

Data Security for Child-Related Information:

  • Reasonable security measures to protect your information via industry standard methods (SSL, Encryption, etc.).
    • While no method of transmission or storage is completely secure, we are committed to taking appropriate steps to safeguard your personal information.
  • Limited access controls for child information
  • Regular security audits and monitoring
  • For Account Holders who have been inactive on our Platform, who have provided Child-Related Information, we may remove certain Personal Information or Child-Related Information to minimize disclosure in case of a worst case scenario data breach.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

In addition, we may disclose personal information that we collect or you provide:

  • Between Account Holders and Caretakers: BloomFam does not control how Account Holders or Caretakers choose to use information they receive about each other through the Service or in their off-platform communications. Any agreements, expectations, or obligations regarding the use, retention, or protection of such information are solely between those users. BloomFam does not create, participate in, or become a party to any employment, contractor, or service relationship between Account Holders and Caretakers, and we do not supervise, direct, or control the childcare services they agree to provide.
    • Account Holder profiles, including their name, the general location of the booking (but not the full street address until a booking is confirmed), and information about the child or children (as provided by the Account Holder), are shared with Caretakers they contact or book.
    • A Caretaker's profile, including their name, photo, qualifications, and bio, is visible to Account Holders. User-initiated exchange of contact information: If Account Holders or Caretakers choose to share their own contact details (such as phone numbers, email addresses, or full street addresses) in messages or other User Contributions, that information is shared directly by those users at their own discretion. BloomFam does not require users to exchange contact information and does not control how users choose to use information they receive from one another outside the Service.
  • Service Providers: To contractors, service providers, and other third parties we use to support our business who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • Stripe: for payment processing in connection with childcare services.
  • Business Transfer: To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of BloomFam's assets.
  • Legal Reasons: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, or in urgent circumstances to protect the personal safety of Users or the public.
  • As well as:
    • To fulfill the purpose for which you provide it.
    • For any other purpose disclosed by us when you provide the information.
    • With your consent.

Your Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Service may then be inaccessible or not function properly.
  • Location Information. You can choose whether or not to allow the Service to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, location-based matching and safety features will not function properly.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website – HERE - or the Digital Advertising Alliance ("DAA") on their opt-out page.

Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the Service and visiting your account profile page.

You may also send us an email at help@getbloomfam.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account.

Children and Child Information

Children Under the Age of 18

The Service is not intended for children under 18 years of age. No one under age 18 may provide any personal information to or through this Service

We do not knowingly collect personal information directly from children under 18. If you are under 18, do not use or provide any information on this Service, create an account on the Service, or provide any information about yourself to us.

Information About Children Collected from Account Holders

BloomFam is a childcare platform that connects Account Holders with childcare providers.

While children do not directly use our Service, we collect basic information about children from the Account Holders to facilitate childcare services. This information includes only basic, non-medical information such as:

  • Child's first name and age
  • Basic care instructions (bedtime, meal preferences, activities)
  • Non-medical behavioral preferences

We explicitly DO NOT collect:

  • Medical information, diagnoses, or health conditions
  • Prescription medications or dosages
  • Allergy information or medical restrictions
  • Any protected health information

Account Holders Consent: By providing information about the child or children through the Service, you consent to our collection and use of this basic information solely for the purpose of facilitating childcare services.

Child Data Protection: We implement enhanced security measures for child information and limit access to authorized personnel only. Child information is never sold, shared for marketing purposes, or used for any purpose other than facilitating childcare services.

Health Information Exclusion

BloomFam does NOT collect, store, or process any health information, including:

  • Medical conditions, diagnoses, or health status
  • Prescription medications or medical treatments
  • Allergy information or dietary restrictions for medical reasons
  • Protected health information (PHI) of any kind
  • Medical emergency information

If we learn we have collected medical or health information about a child, we will delete that information immediately. If you believe we might have any medical information about a child, please contact us at help@getbloomfam.com.

For any medical needs or health-related care instructions, Account Holders should communicate directly with caretakers outside of the BloomFam platform.

Your State Privacy Rights

Many states, including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information and nature processing purpose (excluding Iowa and Utah).
  • Data portability.
  • Opt-out of personal data processing for: targeted advertising (excluding Iowa); sales; or profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
  • Limit or require consent to process sensitive personal data
  • Special Protections for Child Information
    • For information about children collected from Account Holders, we provide enhanced protections including:
      • Guardian consent verification before collection
      • Limited processing only for childcare service facilitation
      • Enhanced security measures and access controls
      • Automatic deletion procedures after service completion
      • Prohibition on sale or marketing use of child information

To exercise any of these rights, please contact us at help@getbloomfam.com with "Privacy Rights Request" in the subject line. Include your full name, account email, and specific request details. To appeal a decision regarding a consumer rights request, email help@getbloomfam.com with "Privacy Appeal" in the subject line within 30 days of our initial response.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

You are responsible for keeping your password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Service

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users' personal information, we will notify you by email to the primary email address specified in your account and through a notice on the Service.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
